Attachment A
Explanation Referred to in Part IV, Item (3) of Form 12b-25
As disclosed in the Companys Form 10-Q for the quarters ended June 30, 2006 and September 30, 2006, the Company reported an $11.4 million interest expense charge in connection with the adjustment in accrued accretion and dividends on its public preferred stock. Primarily due to this adjustment, as well as an additional operating loss of $3.2 million due to a decrease in gross margin and an increase in unreimbursed litigation-related expenses, net loss for the period ended December 31, 2006 increased by $15.6 million compared to the same period in 2005, to $29.7 million.
